Terms of Sale
These terms apply when you buy from Atelier Ceramics, as a consumer or as a trade customer. Read them with our returns page and our delivery page.
Who you are buying from
You are buying from Atelier Ceramics, the trading name of Nunes Tiling Ltd (NZBN 9429051973155, GST 141-776-347), Unit 2/4 Cemetery Road, Cromwell 9310, Central Otago, New Zealand.

Prices and GST
Prices on the website are shown excluding GST, with the GST-inclusive amount beside them at the same size. GST is 15%. At checkout we show a subtotal excluding GST, the freight (if any), the GST, and the total including GST.
The amount you pay is that total, plus any card or buy-now-pay-later surcharge shown before you pay. Freight on the website is an estimate until we confirm it. We confirm the final freight before you pay.
Trade prices, full-box prices and pallet prices (where shown) are for approved trade accounts. A pallet price is for pickup at our Cromwell store.
Orders and payment
Placing an order is a request to buy. We accept it when we confirm the order, including stock and the final freight where there is a delivery.
You do not pay until we have confirmed the total, unless the website tells you that an in-stock order can be paid straight away.
You can pay by bank transfer (no surcharge) or by card. Card payments are processed by Stripe. We do not store your card number. A card surcharge, where it applies, is shown before you pay and is not refunded.
Where we offer it, you may pay with Afterpay or Klarna through Stripe. Any fee is shown before you pay. Those options are for consumer orders, not for orders at a trade price.
An approved trade customer may put an order on their account, under the trade account terms they accepted. Those account terms cover the due date, the credit limit, and (where they say so) a personal guarantee.
Freight and pallets
Tile orders are sent on a pallet. Smaller orders of supplies (adhesive, grout, tools and similar) may go by courier.
The website may show a freight estimate for tiles. The final freight is confirmed before you pay. That figure is an estimate of cost, not a promised arrival day. Delivery times are estimates only.
Remote or hard-to-reach addresses may cost more. The delivery address needs to be correct, and the site needs to be safe and reachable for the truck. Someone may need to be there to receive the goods. A failed delivery or a redelivery may be charged.
Freight is not refunded if you change your mind. Where we arranged the carrier, we help you lodge a claim for damage in transit.
Risk and delivery
Risk in the goods passes to you when you collect them from our Cromwell store, or when they are delivered to the address you gave us.
Please inspect the goods on delivery and tell us about damage, shortages or other problems within 48 hours, with photos. Our delivery page sets out the same points.
This passing of risk does not limit your rights if the goods are faulty.
Colour, shade and batch
Tiles are made from natural and fired materials. Shade, tone, texture and finish can vary between batches, and size can vary by a small industry tolerance. Photos on the website are a guide: light, batch and screens change how a tile looks.
Order enough from one batch for the job, including an allowance for cuts, and check the goods before they are installed. Installation is treated as acceptance of the appearance of the goods, except where the goods are faulty.
What you can return, and what happens with faulty or wrong goods, is set out on our returns page. Please read it before you order and before you install.
Returns
Our returns page is part of these terms. It covers change-of-mind returns, goods we cannot take back, faulty or wrong goods, refunds and cancellations.
Nothing on that page, and nothing in these terms, limits the rights of a consumer under the Consumer Guarantees Act 1993.
Consumer law
If you buy as a consumer, nothing in these terms limits your rights under the Consumer Guarantees Act 1993 or the Fair Trading Act 1986.
If you buy for a business, the Consumer Guarantees Act may be contracted out of only where section 43 of that Act allows it, and only where the written trade account terms say so. The Fair Trading Act still applies.
Where a term would limit a right that the law does not allow us to limit, that term gives way.
Other
New Zealand law applies, and the New Zealand courts have jurisdiction.
If we do not insist on a term once, we can still rely on it later.
These terms, the returns page and the delivery page are the terms of sale for the website. Trade account terms apply as well where you buy on account.
