OVERVIEW

Welcome to Atelier Ceramics. The terms "we", "us" and "our" refer to Atelier Ceramics. We operate this store and website, including all related services (the "Services").

By using our Services, you agree to these Terms of Service and our Privacy Policy.

Nothing in these Terms limits your rights under the Consumer Guarantees Act 1993 (CGA) where applicable.


SECTION 1 - ACCESS AND ACCOUNT

You confirm that you are of legal age in New Zealand or have consent from a legal guardian.

You agree to provide accurate and complete information and are responsible for maintaining the security of your account.


SECTION 2 - OUR PRODUCTS

We make every effort to accurately display our products. However:

  • Colours and appearance may vary due to screens, lighting, and manufacturing

  • Tiles and materials may vary in shade, tone, texture, and batch

  • Size tolerances of up to ±1–2mm are industry standard

These variations are normal and not considered defects.

To the extent permitted by New Zealand law, we do not guarantee exact visual consistency with website images.


SECTION 3 - CUSTOMER RESPONSIBILITY

Customers must:

  • Inspect all goods upon delivery

  • Confirm suitability prior to installation

  • Ensure correct quantities are ordered (including wastage)

No claims will be accepted after installation unless the product is proven to be faulty under the Consumer Guarantees Act.


SECTION 4 - ORDERS

All orders are subject to acceptance.

Orders may not be cancelled once confirmed, except where required under New Zealand law.

We reserve the right to accept or decline any order.

Purchases may be for personal or business use.


SECTION 5 - PRICES AND BILLING

Prices are subject to change without notice.

You agree to provide accurate payment and billing information.


SECTION 6 - SHIPPING AND DELIVERY

Delivery timeframes are estimates only.

Risk passes to the customer upon delivery.

Where delivery is arranged by us, we will assist in resolving issues with the carrier.

All goods must be inspected upon delivery.

Any damage, shortage, or issue must be reported within 48 hours with photographic evidence.


SECTION 7 - TRANSPORT DAMAGE

All goods leave our premises in good condition.

Transport is handled by third-party carriers. We will assist with claims where appropriate; however, liability may rest with the carrier.


SECTION 8 - RETURNS

Returns are subject to our Refund Policy.

We reserve the right to:

  • Refuse returns not meeting policy requirements

  • Apply restocking fees

  • Decline returns where goods have been used or installed


SECTION 9 - INSTALLATION DISCLAIMER

All products must be inspected prior to installation.

Installation constitutes acceptance of the product.

We are not responsible for:

  • Incorrect installation

  • Incorrect product selection

  • Failure to follow manufacturer guidelines

We are not responsible for third-party tools, services, or websites.

To the maximum extent permitted by New Zealand law:

  • We are not liable for indirect or consequential loss

  • Liability is limited to repair, replacement, or refund

Nothing in this clause limits rights under the Consumer Guarantees Act.


SECTION 17 - TRADE / BUSINESS CUSTOMERS

Where goods are supplied for business purposes, the Consumer Guarantees Act 1993 will not apply to the extent permitted by law.


SECTION 18 - CHARGEBACKS & DISPUTES

By completing a purchase, you confirm that:

  • You have reviewed product details and policies

  • Products are suitable for your intended use

  • Goods will be inspected prior to installation

We reserve the right to dispute any chargeback using delivery confirmation, communication records, and acceptance of these Terms.

We may recover costs associated with fraudulent or unjustified chargebacks.


SECTION 19 - GOVERNING LAW

These Terms are governed by the laws of New Zealand.


SECTION 20 - CHANGES TO TERMS

We may update these Terms at any time. Continued use of the Services constitutes acceptance.
